Algemene Voorwaarden Studio Bies

Definities
In deze voorwaarden wordt verstaan onder:

• Studio Bies: de eenmanszaak Studio Bies, gevestigd te Amsterdam, handelend onder de naam Studio Bies.
• Klant: de natuurlijke persoon of rechtspersoon die een bestelling doet bij Studio Bies.
• Producten: de artikelen die via de website van Studio Bies worden aangeboden en verkocht.
• Diensten: het op maat maken van producten door Studio Bies.
• Overeenkomst: de overeenkomst op afstand tussen Studio Bies en de Klant met betrekking tot de verkoop van Producten of de levering van Diensten.

1. Toepasselijkheid

Deze algemene voorwaarden zijn van toepassing op alle bestellingen die via studiobies.nl worden geplaatst. Door een bestelling te plaatsen ga je akkoord met deze voorwaarden.

2. Producten en prijzen

Alle prijzen op de website zijn inclusief 21% BTW. Afbeeldingen op de website geven een zo nauwkeurig mogelijk beeld van de producten. Kleuren kunnen afwijken afhankelijk van je beeldscherm. Studio Bies behoudt zich het recht voor om prijzen te wijzigen. De prijs die geldt op het moment van bestelling is de prijs die je betaalt.

3. Bestelling en betaling

Een bestelling van de Klant is definitief na ontvangst van je betalingsbevestiging. Betalen kan via iDEAL. Studio Bies behoudt zich het recht voor een bestelling te weigeren, bijvoorbeeld bij vermoedens van fraude. In dat geval word de Klant zo snel mogelijk op de hoogte gesteld.

4. Verzending en levering

Bestellingen worden verzonden naar adressen in Nederland. De verzendkosten bedragen €6,95 per bestelling. Studio Bies streeft ernaar om op voorraad zijnde Producten binnen 1–2 dagen te verzenden. Indien een artikel een langere levertijd heeft of tijdelijk niet leverbaar is, ontvangt de Klant hiervan binnen enkele dagen bericht via e‑mail. Studio Bies is niet aansprakelijk voor vertragingen, onvolledige of ontbrekende leveringen veroorzaakt door vervoerders zoals PostNL, DHL of UPS. Eventuele schade als gevolg van overschrijding van aangekondigde levertijden wordt niet vergoed. Studio Bies behandelt bestellingen met de grootste zorg. Mocht een bestelling desondanks door toedoen van Studio Bies niet of onvolledig worden geleverd, meldt de klant dit dan binnen 7 dagen na ontvangst.

5. Herroepingsrecht (14 dagen bedenktijd)

De Klant heeft het recht om de bestelling zonder opgave van reden te annuleren binnen 14 dagen na ontvangst van Producten. Studio Bies doet er alles aan om de Klant een perfect product te leveren. De Klant dient de geleverde artikelen direct na ontvangst te inspecteren. Mocht een artikel niet aan de verwachtingen van de Klant voldoen, dan dient de Klant dit per e‑mail te melden via info@studiobies.nl . Retouren dienen vooraf aan Studio Bies te worden gemeld en met het retourformulier te worden verzonden. De Klant draagt de kosten voor het retourneren van het product. Studio Bies zal klachten in overleg met de Klant en op de best mogelijke manier proberen op te lossen.

Indien binnen 14 dagen geen schriftelijke bezwaren zijn ontvangen, gaat Studio Bies ervan uit aan haar verplichtingen te hebben voldaan. De Klant heeft het recht om Producten binnen 14 dagen na ontvangst te retourneren. Tijdens deze zichttermijn dient de Klant zorgvuldig om te gaan met Producten en de verpakking; de Klant mag het product slechts in die mate uitpakken of gebruiken als nodig is om te beoordelen of hij/zij het wil behouden. Retourneren dient te gebeuren in de originele verpakking. Indien de Producten ongebruikt, onbeschadigd en tijdig geretourneerd zijn, ontvangt de klant de betaalde prijs exclusief verzendkosten uiterlijk binnen 30 dagen terug. Retouren die later dan 14 dagen worden verzonden, worden beschouwd als geaccepteerd. Gepersonaliseerde Producten en Diensten en digitale Producten kunnen niet worden geretourneerd.

6. Aansprakelijkheid

Studio Bies, haar personeel en de door Studio Bies geleverde producten zijn niet aansprakelijk voor enige directe of indirecte schade, behalve in geval van opzet of grove schuld aan de zijde van Studio Bies. Studio Bies is evenmin aansprakelijk voor schade die bij uitvoering van de Overeenkomst door derden wordt veroorzaakt. De aansprakelijkheid van Studio Bies is altijd beperkt tot het bedrag van de aankoopprijs van het betreffende Product. Studio Bies is niet aansprakelijk voor misverstanden, verminkingen, vertragingen of onjuist overkomen van bestellingen en mededelingen als gevolg van gebruik van internet of andere communicatiemiddelen tussen de Klant en Studio Bies, tenzij er sprake is van opzet of grove schuld.

7. Overmacht

In situaties van overmacht worden de verplichtingen van Studio Bies opgeschort. Indien de overmacht langer dan twee maanden duurt, hebben zowel de Klant als Studio Bies het recht de Overeenkomst te ontbinden zonder verplichting tot schadevergoeding. Onder overmacht vallen onder meer stakingen, storingen, onherstelbare materiële schade en natuurrampen, ongeacht of deze zich voordoen bij Studio Bies of haar toeleveranciers.

8. Intellectueel Eigendom

Alle rechten van intellectueel eigendom met betrekking tot de website, teksten, foto’s, patronen, ontwerpen, illustraties en andere materialen van Studio Bies berusten bij Studio Bies of haar licentiegevers. Het is niet toegestaan deze materialen zonder voorafgaande schriftelijke toestemming te kopiëren, reproduceren, publiceren of op enige andere wijze te gebruiken voor commerciële of publieke doeleinden. Indien Studio Bies een inbreuk op haar intellectuele eigendom ontdekt, zal zij tegen de inbreukmakende partij juridische stappen ondernemen op basis van Nederlands recht.

9. Klachten en garantie

Klachten over producten, diensten of deze voorwaarden kan de Klant per e‑mail richten aan info@studiobies.nl. Studio Bies streeft ernaar om binnen 5 werkdagen inhoudelijk te reageren. Indien een klacht een langere verwerkingstijd vergt, ontvangt de klant binnen deze termijn een bericht van ontvangst met een indicatie wanneer hij/zij een meer uitvoerig antwoord kan verwachten. Indien een klacht niet in onderling overleg kan worden opgelost, ontstaat een geschil waarop de onderstaande bepaling 11 van toepassing.

10. Privacy

Studio Bies verwerkt je persoonsgegevens alleen voor het uitvoeren van je bestelling en om contact met je op te nemen. Lees ons volledige privacybeleid op de website. 

11. Toepasselijk recht

Op alle overeenkomsten met Studio Bies is Nederlands recht van toepassing. Bij geschillen proberen wij er samen uit te komen. Lukt dat niet, dan is de bevoegde rechter in Nederland van toepassing.

Terms and Conditions Studio Bies (English)

Definitions

In these terms and conditions, the following definitions apply:

• Studio Bies: the sole proprietorship (eenmanszaak) Studio Bies, established in Amsterdam, trading under the name Studio Bies.
• Customer: the natural person or legal entity that places an order with Studio Bies.
• Products: the items offered and sold via the Studio Bies website.
• Services: the custom-making of products by Studio Bies.
• Agreement: the distance contract between Studio Bies and the Customer relating to the sale of Products or the provision of Services.

1. Applicability

These general terms and conditions apply to all orders placed via studiobies.nl. By placing an order, you agree to these terms and conditions.

2. Products and prices

All prices on the website include 21% VAT. Images on the website provide as accurate a representation of the products as possible. Colours may vary depending on your screen. Studio Bies reserves the right to change prices. The price applicable at the time of ordering is the price you pay.

3. Order and payment

An order placed by the Customer is final upon receipt of your payment confirmation. Payment can be made via iDEAL. Studio Bies reserves the right to refuse an order, for example in case of suspected fraud. In that case, the Customer will be notified as soon as possible.

4. Shipping and delivery

Orders are shipped to addresses in the Netherlands. Shipping costs amount to €6.95 per order. Studio Bies aims to ship Products that are in stock within 1–2 days. If an item has a longer delivery time or is temporarily unavailable, the Customer will receive notice of this by e-mail within a few days. Studio Bies is not liable for delays, incomplete deliveries, or missing deliveries caused by carriers such as PostNL, DHL, or UPS. Any damage resulting from exceeding announced delivery times will not be compensated. Studio Bies handles orders with the utmost care. Should an order nevertheless not be delivered, or be delivered incompletely, due to the fault of Studio Bies, the Customer must report this within 7 days of receipt.

5. Right of withdrawal (14-day cooling-off period)

The Customer has the right to cancel the order without giving any reason within 14 days of receipt of the Products. Studio Bies does everything it can to deliver the Customer a perfect product. The Customer must inspect the delivered items immediately upon receipt. Should an item not meet the Customer's expectations, the Customer must report this by e-mail to info@studiobies.nl. Returns must be reported to Studio Bies in advance and sent together with the return form. The Customer bears the costs of returning the product. Studio Bies will attempt to resolve complaints in consultation with the Customer and in the best possible manner.

If no written objections are received within 14 days, Studio Bies will assume that it has fulfilled its obligations. The Customer has the right to return Products within 14 days of receipt. During this inspection period, the Customer must handle the Products and packaging with care; the Customer may only unpack or use the product to the extent necessary to assess whether they wish to keep it. Returns must be made in the original packaging. If the Products are returned unused, undamaged, and in a timely manner, the Customer will receive a refund of the price paid, excluding shipping costs, within 30 days at the latest. Returns sent later than 14 days will be considered accepted. Personalised Products and Services and digital Products cannot be returned.

6. Liability

Studio Bies, its staff, and the products supplied by Studio Bies are not liable for any direct or indirect damage, except in the event of intent or gross negligence on the part of Studio Bies. Nor is Studio Bies liable for damage caused by third parties in the performance of the Agreement. The liability of Studio Bies is always limited to the amount of the purchase price of the relevant Product. Studio Bies is not liable for misunderstandings, mutilations, delays, or incorrect transmission of orders and communications as a result of the use of the internet or other means of communication between the Customer and Studio Bies, unless there is intent or gross negligence.

7. Force majeure

In situations of force majeure, the obligations of Studio Bies are suspended. If the force majeure situation lasts longer than two months, both the Customer and Studio Bies have the right to terminate the Agreement without any obligation to pay damages. Force majeure includes, among other things, strikes, disruptions, irreparable material damage, and natural disasters, regardless of whether these occur at Studio Bies or at its suppliers.

8. Intellectual Property

All intellectual property rights relating to the website, texts, photographs, patterns, designs, illustrations, and other materials of Studio Bies belong to Studio Bies or its licensors. It is not permitted to copy, reproduce, publish, or otherwise use these materials for commercial or public purposes without prior written consent. If Studio Bies discovers an infringement of its intellectual property, it will take legal action against the infringing party on the basis of Dutch law.

9. Complaints and warranty

The Customer may address complaints about products, services, or these terms and conditions by e-mail to info@studiobies.nl. Studio Bies aims to respond substantively within 5 working days. If a complaint requires a longer processing time, the Customer will receive, within this period, an acknowledgement of receipt indicating when a more detailed response can be expected. If a complaint cannot be resolved by mutual agreement, a dispute arises to which the provision below 11 applies.

10. Privacy

Studio Bies processes your personal data only to fulfil your order and to contact you. Please read our full privacy policy on the website.

11. Governing law

Dutch law applies to all agreements with Studio Bies. In the event of disputes, we will try to resolve them together. If this is not possible, the competent court in the Netherlands has jurisdiction.
